EU Cookie Law – ICO publishes guidelines

As mentioned in one of my previous posts about EU legislation the new Cookie Law is coming, with force, into force on the 26th of May. The ICO published less than helpful and very vague guidelines today.

The gist is that:

  • You can’t sit it out. You have to do something
  • Even if future browser versions support a sophisticated level of cookie management you need to implement something that works with older browsers
  • Simply changing your T&C will not be enough
  • Shop/Basket cookies are OK but your Google Analytics cookies may not be

Having had your customer previously agree to your T&C when they signed up would mean that you need to email all of them, put a link in and make them agree to the new T&C. Here you will need to prominently explain the change in cookie handling.
They do admit that the “overlay/pop-up” solution will spoil the experience but it looks like one of the few options apart from making everyone agree upfront to your T&C on a splash page (yeah we can use Flash here and make everything shine and glitzy).

I’ll keep you posted, Pod1 will be looking how to comply with these new regulations.
